The seller
The Shop is operated under the name Night Sky Studio. The legal entity is [legal entity]. The postal address is [postal address]. Neither is stated as a fact on this page because it is not in the Shop’s records used for this page. Questions about these terms go to help@nightskystitch.com. Transactional email about an order is sent from patterns@nightskystitch.com when that sending address is configured.
Definitions
“Shop” means the Night Sky Studio website at https://nightskystitch.com.
“Pattern” means a digital cross-stitch pattern sold as a PDF, including its chart, symbol key, and instructions. A Pattern is not fabric, floss, a needle, a hoop, a kit, or a finished stitched object.
“Order” means a purchase that Stripe has reported as paid and that the Shop has recorded.
“Pattern License” means the license in “Pattern license,” unless the product page for that Pattern states a different license in the way that section describes.
“You” means the person who uses the Shop or buys a Pattern.
What is sold
The Shop sells Patterns. A bundle is a set of Patterns sold at one price. A listing does not include physical materials or a finished object. Measurements, difficulty, and supply notes on a listing are that listing’s stated details. The file an Order entitles you to download is the pattern version recorded on the Order, not a later version of the listing.
Orders and payment
You pay through Stripe Checkout. The Shop creates an Order only after Stripe reports the payment as paid. Leaving Checkout before that report does not create an Order. Each line is charged at its Stripe Price in US dollars. The bag holds at most one of each Pattern or bundle.
The Shop does not discount a Pattern because that Pattern is also inside a bundle in the same bag. Each line is charged on its own.
If checkout is not enabled, the Shop does not take payment and does not create an Order. This page does not promise that checkout is enabled on any particular visit.
Pattern license
Unless the product page for a Pattern states a different license, the Shop grants you a personal, non-exclusive, non-transferable license to download the PDF for the pattern version on your Order and to use that PDF to stitch the design for your own personal use.
Personal use includes stitching the design yourself. It includes giving away a finished physical object that you do not sell and that you do not stitch for a fee.
Personal use does not include, and you may not: copy the PDF except as a backup for your own use; share, post, lend, rent, or sell the PDF or any chart, key, or instructions taken from it; give your download link to anyone else; or redistribute the Pattern in another file or format. You may not sell a finished object made from the Pattern, and you may not stitch it for a fee, unless the product page for that Pattern states in plain words that you may.
If the product page states a different license in plain words, that statement is the license for that Pattern. A product page that does not state a license, or that says only that a license is not set or is still awaiting approval, does not state a different license. The Pattern License on this page applies to that Pattern.
The Pattern License for an Order ends if a full refund revokes download access, or if a card-dispute notice revokes download access, as stated in the digital delivery and refunds policy. You must then stop using the Pattern and you must not distribute it. The Shop can stop new downloads. It cannot delete a file already saved on your device.
Accounts
The Shop does not issue a password or a customer account. The Shop identifies the buyer by the email address collected at Stripe Checkout. You are responsible for that email address. Do not publish a download link.
Price and tax
Prices are in US dollars. The Shop does not currently enable Stripe Tax, so Checkout does not add tax and does not require a billing address while that setting is off. [tax status] A price displayed by the Shop is not a statement that the Shop is registered to collect tax.
Delivery and refunds
Delivery, recovery of a download link, refunds, and the effect of a dispute on download access are stated at /policies/digital-delivery. That policy is part of these terms for an Order.
Liability, law, and consumer rights
The Shop does not state a warranty period or a damages cap on this page. [disclaimer of warranties] [limitation of liability] The governing law is [governing law]. The courts are [venue]. Rights that apply to you because of where you live are [consumer rights]. Nothing on this page waives a right that cannot legally be waived. The Shop does not, on this page, name a statute or a jurisdiction, because those facts are not in the records used for this page.
Changes
The Shop may replace these terms by publishing a new version at this URL. An Order is governed by the terms published at the time Stripe reports that payment as paid. A later edit applies to later Orders. Editing this page does not re-license a past Order.
